Duty of Care
If you have waste you have a legal ‘Duty of Care’ to ensure that it is managed and disposed of correctly, and in line with current legislation. This Duty of Care applies to everyone involved in handling the waste: from the person who produces it, to the person who finally disposes of it.
Anyone who is involved in handling waste in ANY way, may be subject to the requirement to hold a Waste Carrier Licence (some exemptions exist), and this may apply to you, within your role as a professional organiser, depending on the services you offer your clients.
You MUST register as a waste carrier, broker or dealer if you do any of the following as part of your business:
– transport your own waste
– transport or dispose of waste for someone else
– buy or sell waste
– act as a waste broker(arrange for someone to handle other people’s waste)
What is Waste?
Items taken from your client that are only for charity shop donation, do not count as waste. If this applies to you, and these are the ONLY items you remove from your client property, you do not need to apply fora Waste Carrier Licence.
If, however, you remove any other item which is for disposal, whether recycling or rubbish, then this is waste and you will need a licence. You can be prosecuted and fined up to £5,000 if you don’t register when you are legally obliged to do so. Members of the public can also be prosecuted and fined if they allow someone who does not have a Waste Carrier Licence to remove or dispose of waste on their behalf. Registered licence holders are listed on the public register of waste carriers on the Environment Agency website.
Waste Carrier Licences
Waste Carrier Licences are issued by the UK Environment Agency to people registered as regularly carrying controlled waste (household, commercial and industrial waste) to or from any place in Great Britain, as part of their business or otherwise for profit.
